Federal Court to Hear Arguments in Challenge to McKeesport School's Failure to Approve Black Student Union
On Monday, a federal district court in Pittsburgh will hear arguments in a civil rights lawsuit challenging the McKeesport Area School District’s failure to approve a proposed Black Student Union club. The lawsuit was filed by 11 students from the district who are represented by the American Civil Liberties Union of Pennsylvania. The ACLU of Pennsylvania argues that the school’s failure to approve the club is a violation of the First Amendment and of the federal Equal Access Act. On Wednesday, the School District's lawyers filed documents arguing the case should be dismissed and seeking to postpone Monday's hearing.
The arguments will be heard by the Honorable Marilyn J. Horan of the United States District Court for the Western District of Pennsylvania.
WHAT: Arguments on a motion for a preliminary injunction in McKeesport Black Student Union v. McKeesport Area School District. Witnesses will include several students and Superintendent Mark Holtzman.
WHEN: Monday, April 22, 2019, at 9am
WHERE: Joseph F. Weis, Jr. U.S. Courthouse, 700 Grant Street, 8th floor, Pittsburgh, PA
